What Phate is

Phate computes your birth chart from real astronomical data and produces a written reading and a drawing from it. It is astrology. It is for reflection and entertainment. It is not advice, it is not a prediction, and it is not a statement about any real person. Do not use it to make medical, financial, legal or other important decisions.

The sketch is a generated drawing, made by an image model from your chart and your own words, and the page that delivers it says so.

Who can use it

You must be 18 or older. Phate asks you to confirm that you are 18 or older and records that you did. It does not verify your age.

What you pay

No card processor is connected yet, so no card is taken and nothing is charged; the amounts and the billing terms you agree to are shown on the price page, and this section names the processor once one is connected. The rest of this section says how charging will work from then.

The amount charged today, the recurring amount, the interval and the exact date of the first recurring charge are shown in numerals on the price page, above the button. Those numbers are the agreement. Wherever this page says the amounts shown on the price page, it means them.

When a charge is made, it shows as PHATE on your statement.

A month means a calendar month: 12 charges a year, never 13.

The price you agreed to on the price page is the price you keep. If it ever changes, you are told by email first, with time to cancel before the new price applies to you.

There is nothing else for sale. One subscription is the whole product: no add-on, no part of the reading held back for a further payment, no fee to make anything arrive faster.

Cancelling

To cancel, write to hello@phate.app. A person stops the subscription within 5 days and confirms by email. You keep everything you have paid for.

What you have paid for runs to the end of the period it covers, and the sketch and the written reading stay yours after that.

Refunds

Charges are not refunded. The billing terms you agreed to on the price page say so in those words, and the refund policy says the same.

Where the law where you live gives you a right to withdraw from a purchase or to a refund, these terms do not reduce it.

A chargeback is your card issuer's process, not Phate's. Phate answers one with the record it keeps. When you agree to something on the price page, or tick the line under a comparison in your account, Phate records the exact words you agreed to, the time, your IP address and the identification string your browser sends.

If something is wrong with your sketch, write to hello@phate.app. A person looks at it within 5 days.

Emails

Phate sends two kinds of email on its own: the one that delivers your sketch, and the weekly note. It sends a sign in link only to an address that asked for one, or, while sketches are free, pressed the price page's button with an order already behind it; a deletion confirmation only when one is asked for at your address. Neither does anything until you open it. Beyond those it writes to you only to answer you, or to give a notice the law requires, such as a change to the price or to the terms. Every weekly note carries a link that stops the weekly note, and nothing else. Stopping the note does not cancel the subscription.

What is yours and what is ours

Your birth details and your answers are yours.

The sketch and the written reading are yours to keep and to share for your own personal purposes. They stay yours after you cancel: a file and a page you keep, not something that expires with the subscription.

Phate itself stays ours: the site, the software, the engine and the writing on the site.

The permission you give Phate over your details is narrow: to produce and deliver your order and to write your weekly note, and nothing else. They are not used to train a model, they are not used for advertising, and they are not licensed to anyone.

What we promise and what we do not

Phate computes your chart from what you give it, and says plainly when it cannot. No birth time means no Ascendant and no Descendant, and no guess in their place. When that happens, your reading carries this sentence:

No birth time, so there is no Ascendant and no Descendant here. The Ascendant crosses all twelve signs in a day, so a guessed hour gives a guessed answer, and the seventh house is the strongest signal there is for a partner. Working from Sun, Venus, Mars and Moon instead.

Phate does not promise that any reading is true, that any person it describes exists, or that anything will happen.

Fair use

• Do not resell what Phate makes for you.
• Do not scrape the site or take its engine.
• Do not attack the site or the systems behind it.
• Do not use anything Phate makes to harass anyone.

Phate can refuse further service to anyone who does.

Liability

Phate is made for reflection and entertainment. It promises nothing about any person a reading or a sketch describes, and it does not promise that you will meet anyone. To the extent the law allows, Phate's liability for anything arising from the site or from what it makes for you is limited to what you paid Phate in the 12 months before the claim, and Phate is not liable for indirect or consequential loss. Nothing here limits a liability that the law does not allow to be limited.

Disputes and governing law

These terms are governed by the laws of the State of California, United States. If something goes wrong, write to hello@phate.app first: a person answers within 5 days, and Phate asks for that time to put it right. A dispute that cannot be settled that way is heard by a court in California. Nothing here takes away a right you have under the consumer law of the place you live. There is no arbitration clause in these terms and no class action waiver.

Changes

When these terms change, the new text is posted here with a new date at the foot of the page. Before a material change takes effect, you are told by email. A change never reaches back to a purchase you have already made.

These are Phate's first terms, written plainly; a lawyer reads them next, and any new text is posted here with a new date.
